These Terms of Service ("Terms") govern your access to and use of services provided by Bad Gasoline Screen Printing ("Bad Gasoline," "Company," "we," "our," or "us").
By requesting a quote, placing an order, submitting artwork, purchasing products, joining a membership program, attending an event, or using our website, you agree to these Terms.
1. SERVICES
Bad Gasoline provides services including but not limited to:
- Screen printing
- Live screen printing
- Graphic design
- Sign printing
- Promotional products
- Apparel decoration
- Software development
- Web design
- Membership studio access
- Consulting
- Creative services
We reserve the right to refuse service to any individual or organization at our sole discretion.
2. QUOTES AND ESTIMATES
All quotes are estimates and are valid for thirty (30) days unless otherwise stated.
Pricing may change due to:
- Garment availability
- Material costs
- Design changes
- Quantity changes
- Shipping costs
- Rush production requests
Quotes do not guarantee production scheduling until payment requirements are satisfied.
3. PAYMENTS
Unless otherwise agreed:
- Payment is due before production begins.
- Large projects may require deposits.
- Custom projects may require milestone payments.
- Membership fees are billed according to selected membership plans.
Failure to make payment may delay production or result in cancellation.
Customers are responsible for all collection costs, legal fees, and expenses associated with unpaid invoices.
4. CUSTOMER APPROVALS
Customers are responsible for reviewing and approving:
- Artwork proofs
- Mock ups
- Placement
- Colors
- Spelling
- Sizing
- Quantities
Approval of a proof constitutes authorization to proceed.
Bad Gasoline is not responsible for errors that were present in approved proofs.
5. ARTWORK OWNERSHIP
Customers represent and warrant that they possess all rights necessary to use submitted artwork, logos, trademarks, photographs, designs, and other materials.
Bad Gasoline does not verify ownership of submitted materials.
Customers agree to defend, indemnify, and hold harmless Bad Gasoline from claims arising from submitted content.
6. ARTWORK FILES
Customers are responsible for supplying production-ready artwork unless design services are purchased.
Additional art charges may apply for:
- Redrawing artwork
- Vectorization
- Color separations
- Layout adjustments
- File preparation
Final production files created by Bad Gasoline remain Company property unless otherwise agreed in writing.
7. COLOR VARIATIONS
Exact color matching cannot be guaranteed.
Printed colors may vary due to:
- Garment color
- Fabric composition
- Ink absorption
- Monitor calibration
- Manufacturing variations
Reasonable color variation shall not constitute a defect.
8. PRINT LOCATION TOLERANCES
Due to the nature of apparel decoration, slight variations may occur.
The following are considered acceptable:
- Print placement variance
- Registration variance
- Ink density variation
- Minor garment manufacturing inconsistencies
Industry-standard production tolerances shall not be considered defects.
9. GARMENT MANUFACTURING VARIATIONS
Bad Gasoline is not responsible for manufacturer defects including:
- Shade variations
- Size variations
- Seam inconsistencies
- Fabric inconsistencies
- Dye migration
Customers acknowledge that garment manufacturers maintain their own tolerances.
10. CUSTOMER-SUPPLIED GARMENTS
While we may occasionally accept customer-supplied garments, we generally recommend purchasing garments through us.
Customer-supplied items are printed entirely at the customer's risk.
Bad Gasoline is not responsible for:
- Misprints
- Shrinkage
- Dye migration
- Heat-related damage
- Manufacturing defects
- Replacement costs
No guarantees are provided for customer-supplied garments.
11. ORDER SHORTAGES AND OVERRUNS
Due to production realities, finished quantities may vary.
An overrun or under run of up to five percent (5%) shall be considered acceptable.
Customers will be invoiced based on actual delivered quantities.
12. PRODUCTION SCHEDULES
Estimated completion dates are estimates only.
Bad Gasoline shall not be liable for delays caused by:
- Supply chain interruptions
- Equipment failure
- Vendor delays
- Weather
- Shipping carriers
- Labor shortages
- Force majeure events
Time is not guaranteed unless specifically agreed in writing.
13. SHIPPING
Risk of loss transfers upon delivery to the carrier.
Bad Gasoline is not responsible for:
- Carrier delays
- Lost packages
- Damaged shipments
- Delivery exceptions
Claims must be pursued with the carrier when applicable.
14. LIVE SCREEN PRINTING EVENTS
Event organizers are responsible for:
- Adequate space
- Power access
- Safe operating conditions
- Crowd management
Bad Gasoline reserves the right to suspend event operations if safety concerns arise.
Weather, venue restrictions, or unforeseen circumstances may impact live printing services.
15. MEMBERSHIP PROGRAMS
Memberships provide access according to the selected membership plan.
Bad Gasoline reserves the right to:
- Modify membership benefits
- Adjust operating hours
- Change equipment availability
- Suspend memberships for violations
Members assume all risks associated with equipment use.
Members are financially responsible for damage caused through misuse, negligence, or unauthorized use.
Membership fees are non-refundable unless required by law.
16. WEBSITE AND SOFTWARE SERVICES
Bad Gasoline does not guarantee:
- Specific business results
- Search engine rankings
- Lead generation
- Revenue increases
- Platform up time
Third-party platforms may change functionality without notice.
Clients remain responsible for maintaining access to their own domains, hosting accounts, software subscriptions, and third-party services.
17. SIGNS AND INSTALLATIONS
Installation conditions may affect final appearance.
Bad Gasoline is not responsible for:
- Structural conditions
- Surface failures
- Building code compliance
- Permit requirements
- Existing property damage
Customers are responsible for obtaining required approvals and permissions.
18. REFUNDS
Because products are custom manufactured, all sales are generally final.
Refunds, replacements, or credits may be provided solely at our discretion.
Claims must be submitted within seven (7) days of receiving an order.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Bad Gasoline's total liability shall not exceed the amount paid for the affected order.
Bad Gasoline shall not be liable for:
- Lost profits
- Lost business opportunities
- Indirect damages
- Consequential damages
- Incidental damages
- Special damages
20. INDEMNIFICATION
Customers agree to defend, indemnify, and hold harmless Bad Gasoline, its owners, employees, contractors, and affiliates from claims, damages, liabilities, losses, costs, and expenses arising from:
- Submitted artwork
- Customer instructions
- Intellectual property disputes
- Customer negligence
- Violation of applicable laws
21. FORCE MAJEURE
Bad Gasoline shall not be liable for failure to perform due to circumstances beyond reasonable control, including:
- Natural disasters
- Weather events
- Power outages
- Supply shortages
- Labor disputes
- Government actions
- Internet failures
- Equipment failures
22. GOVERNING LAW
These Terms shall be governed by the laws of the State of Missouri without regard to conflict-of-law principles.
Any legal dispute shall be brought exclusively in courts located within Missouri.
23. CHANGES TO THESE TERMS
We reserve the right to update these Terms at any time.
Continued use of our services constitutes acceptance of the updated Terms.
